Atari's Latest Legal Actions ?Appear to be Putting the Squeeze on ...

Summary A project update for iOS game Vector Tanks 3 on crowd-sourcing platform Kickstarter revealed that Atari has started threatening legal action against indie game developers whose creations resemble the company?s ancient arcade titles.

Description In light of threatened legal action, Black Powder Media has pulled Vector Tanks and Vector Tanks Extreme from the app store because ?It doesn?t seem to matter that the game bears only a vague resemblance to Atari?s Battlezone.?

Russian challenger urges joint currency with EU (AP)

MOSCOW ? The Russian billionaire challenging Prime Minister Vladimir Putin in March's presidential election said Thursday that he will push for a common currency with the European Union and liberalize the nation's political scene if elected.

Mikhail Prokhorov, who owns 80 percent of the New Jersey Nets basketball team, didn't detail his proposal for a "common global currency based on the euro and the ruble" in the outline of an election platform that he released on his Live Journal blog. But he pledged to push for Russia's integration into a "Big Europe."

The 46-year-old, who made his fortune in metals, banking and media and is estimated to be worth $18 billion, also promised to disband the parliament elected in a fraud-tainted vote earlier this month, and call for a repeat election next December.

That echoed the demand of participants in recent protests in Russia spurred by allegations of ballot-stuffing and other violations in the Dec. 4 election. Prokhorov attended the latest rally over the weekend, which drew up to 100,000 people ? the biggest protest in Russia's post-Soviet history.

His presidential bid follows his botched performance before the parliamentary election, when he formed a liberal political party with the Kremlin's tacit support but abandoned it under what he called Kremlin pressure.

Some observers have speculated that Prokhorov may have had the Kremlin's blessing to join the presidential race in order to cater to voters angry at the government while creating a semblance of genuine competition. Prokhorov has admitted that the Kremlin would like to use him, but insists he will play his own game and try to foster positive change.

Prokhorov also promised to ease controls on Russia's political scene, which has been tightly controlled by Putin, reform a justice system permeated by corruption and abolish the highly unpopular conscription of soldiers into the military, turning it into a fully professional force instead.

He said in his platform that Putin's so-called "sovereign democracy" masks "a contempt for the people, a readiness to sacrifice them for the sake of geopolitical fantasies."

"It's time to understand that the basis for the nation's successful development isn't in tons of coal, barrels of oil and cubic meters of timber, but in a system of human values shared by the society and protected by law," he said.

"I will build my policy based on a Russian humanitarian tradition that for a long time has been present only in Russian literature. It's time to make it part of the political sphere and the public life."

Iconia Tab A200 and A700 slates head to CES, make a pitstop in Russia

Acer already spilled the beans on its Iconia Tab A200, a 10.1-inch slab powered by NVIDIA's 1GHz Tegra 2 processor, but whatever happened to that Tegra 3 touting A700? It went to Russia, of course. According to NoMobile.ru, the A200's slimmer, but more powerful brother will debut at CES 2012 next month. The Ruskie site pegs the tablet's 1920 x 1200 resolution screen at 10.1-inches, which is bordered by SIM and micro-USB slots, a dedicated rotation lock switch, the standard volume rockers, an audio jack and a micro-HDMI port. On its rear they found a textured back garnished with a five megapixel camera sporting a built-in flash -- the whole unit weights 650 grams (1.43 pounds) and boasts a ten hour battery life. When can we see it? At CES, says NoMobile.ru, or in stores if you're willing to wait until March. We'll poke around Acer's offerings next month and let you know what we find. Can't wait? Follow the source link below for a few more pictures.

Arab observers fan out across Syria (Reuters)

(Reuters) ? Arab monitors head to three more Syrian cities on Thursday to check if government forces are complying with a peace plan after a delegation to Homs, center of the uprising against President Bashar al-Assad, was mobbed by a protesters demanding protection.

The Arab League mission, the first international involvement on the ground in Syria since the revolt began last March, got off to a controversial start when its Sudanese leader said he had seen "nothing frightening" on his first trip to Homs.

He later said he needed more time to make an assessment of the city, which was pounded by government firepower in the days before the visit.

The observers briefly visit Homs on Tuesday then returned to Wednesday with an army escort, to the dismay of demonstrators who mobbed their car.

They finally went back to Baba Amr district, one of the worst-hit, to see shattered houses and hear from people who have lost friends and relatives. One family showed them a dead boy.

They are likely to witness similar scenes on Thursday when they visit Deraa, Hama and Idlib, all cities where anti-Assad demonstrations have been violently repressed.

The observers' leader, Sudanese General Mustafa al-Dabi, said the mission was still in its early days.

"We have 20 people who will be there (in Homs) for a long time," he said.

Opposition activists say the government will play for time and bend the mission to its own ends. But Washington urged then to give Dabi a chance.

"We need let this mission get up and running, let them do their job and then let them give their judgment," State Department spokesman Mark Toner said in Washington.

Unless it can establish its credibility by proving it has unobstructed access to all areas and is able to hear uncensored accounts, the Arab League mission may not be able to satisfy all sides that it can make an objective assessment of the crisis.

Most of the 5,000 or more people estimated by the United Nations to have been killed in Syria since March have lost their lives in Homs, to machinegun fire, sniper bullets, mortar blasts and tank shelling, or torture.

INSURGENCY RISING

What began with peaceful mass protests against Assad has turned into an armed insurrection as thousands of army defectors formed the Syrian Free Army and attacked military and police convoys, bases and checkpoints.

A video shot by rebels showed the ambush of a security forces convoy on Wednesday by eight gunmen who opened fire from a rooftop.

The British-based Syrian Observatory for Human Rights said four soldiers were killed in the attack by rebel troops on a road near the southern village of Dael in Deraa province, cradle of the revolt.

Assad says he is combating Islamic terrorism steered from abroad. He says more than 2,000 security personnel have been killed.

Syria resisted outside involvement for months but yielded to pressure from fellow members of the 22-state Arab League last month, agreeing to let the monitors in to witness a withdrawal of forces from the turbulent cities.

But the killing did not stop, before and during the first two days of the monitoring mission, and opposition activists predict it will not cease after the observers are gone in a month. About 200 observers will deploy to witness and interview victims of violence scattered across the country of 23 million.

The West has demanded that Assad step down but Russia and China oppose intervention. Syria also has the backing of Iran.

Assad, increasingly isolated, has lost the trust of his neighbor Turkey, which has called for him to quit and which allows the rebel army to launch attacks from its territory.

Safeguarding Your Supply Chain Against Rising Oil Prices

Have you considered what the fluctuating cost of oil could be doing to your supply chain? Maybe you are dealing with a fuel surcharge on your logistics invoice or are experiencing increased component and operating costs? In any instance, as the price per barrel changes on a daily basis, you need to be concerned with more than just the prices at the pump. The challenges that ensue can negatively impact your supply chain if your infrastructure is not equipped to handle quick adaptations. However, by planning ahead and reevaluating where your supply chain activities are performed, as well as your current processes, you can face these challenges head-on and lessen the impact on your operations and your bottom line. The record peak for oil occurred in July 2008 when prices reached $147 per barrel. This year's prices are topping $100 per barrel.? While prices at this moment are lower than that, it is unclear where prices will go in 2012. Whether it's up or down, you can prepare your supply chain for rapid fluctuations by following some key best practices: Flexible Infrastructure
Supply chains have undergone dramatic changes in recent years in response to shifting product needs, labor costs, taxes and environmental considerations. Having the flexibility to employ multiple routes to market is an important risk mitigation strategy, but it also provides the capability needed to rebalance product flows in response to changing input costs. Network Optimization
If oil prices increase, you may be forced to look at where distribution centers are located in relation to areas of key demand. For many companies, the combination of higher logistics costs and additional inventory requirements have already triggered the movement of supply chain activities closer to key markets. In an economic climate where the cost of fuel continues to rise uncontrollably, network optimization can help you strike a balance between inventory costs, labor costs and distribution center location(s). A network optimization analysis may result in the addition or closing down of distribution centers or even the movement of centers to more optimal locations. It is important to remember that frequent evaluations are necessary to ensure your supply chain model matches current conditions. Postponement Strategies
A postponement strategy based on your network optimization analysis can help increase the density of product coming from remote manufacturing locations. By sending unfinished or unpackaged goods into regions that are closer to the end consumer for final assembly, you can maintain inventory at a flexible level and reduce fuel costs. Shipping Practices
Making changes to your shipping practices can dramatically impact your bottom line, but can also benefit the environment. And there are several creative approaches to shipping available today. This can be as simple as establishing specific delivery dates with key customers which will enable you to consolidate shipping. You can also partner with a company that is not a competitor and that ships product to the same retail locations. Consolidating shipments between multiple brand owners can lead to a reduction in cost and an increase in shipment density. Organizations such as the European Logistics Users Providers and Enablers Group (ELUPEG) practice and promote collaborative shipping and encourage manufacturers across all industries to partake in an effort to improve asset utilization, carbon reduction, customer service, and more. Environmental Responsibility
Adopting sustainable supply chain practices can help you reduce costs and stay in line with social and corporate environmental responsibilities. One thing to consider is using alternative sources of fuel in your trucks and other vehicles. By using sources other than oil, you can potentially avoid fluctuating prices and the complexities that follow. The Environmental Protection Agency's (EPA) SmartWay Program aims to reduce environmental pollutants caused by traditional fuel sources by providing companies with cleaner alternatives, including ethanol, E85, Biodiesel, and natural gas and propane. Another area to evaluate is product packaging. Bulky product packaging made from synthetic materials and plastics is not friendly to your operations, shipping costs, or the environment. By redesigning packaging to be more compact and made from recyclable materials with little or no plastic, you can increase pallet density which reduces shipping costs, and also decrease your carbon footprint.

VERNON (CBS)?? Lawmakers are questioning the cost of legal bills for the city of Vernon, which is under investigation for its financial dealings.

Vernon paid a law firm nearly $7 million this year, while more than $2 million went to other lawyers and lobbyists defending the city, according to the Los Angeles Times.

Former Attorney General and Vernon ethics adviser Jon Van De Kamp says the legal fees are too high.

Three ex-city officials have already been convicted of misusing public funds.

First Communion service for Texas Episcopalians

On this Christmas Day in 1838, Caleb Smith Ives, an Episcopal priest, celebrated the Holy Eucharist in Matagorda, Texas. This is believed to be the first time it had been celebrated in Texas according to the Episcopal rite. Ives, a native of Vermont, arrived in Texas late in 1838 and established an Episcopal church at Matagorda. He held occasional services in Brazoria and organized St. John's parish at Victoria, but continued to hold the pastorate at Christ Church in Matagorda, where he and his wife operated Matagorda Academy, said to be one of the best academies in Texas. Christ Church was the first Episcopal parish in Texas and, at the time, the most southern and western in the Protestant Episcopal Church of America. Ives died in 1849.

Dutch cup match may be replayed after fan incident

By TOBY STERLING

Associated Press

Associated Press Sports

updated 10:19 a.m. ET Dec. 22, 2011

AMSTERDAM (AP) -The Dutch football federation said Thursday it has yet to decide whether to replay a cup match between Ajax and AZ Alkmaar that was halted after a supporter ran onto the field and tried to attack Alkmaar's goalkeeper.

The alert Costa Rican goalkeeper Esteban Alvarado deflected the attack by a 19-year-old fan, tripping him with a karate-like kick. But Alvarado was given a red card for kicking the supporter again in anger twice immediately afterward before the intruder was dragged off by security guards.

Alkmaar coach Gertjan Verbeek ordered his side to walk out in protest rather than play with 10 men and the game was halted in the 36th minute. Ajax was leading 1-0 on a goal by Gregory van der Wiel.

Ajax director Jeroen Slop said the supporter had already been banned from the stadium for a year due to a previous run-in with security guards, but managed to sneak into the cup match with a ticket purchased by a friend. He has now received a lifetime ban from all Ajax matches.

Later Thursday, the Dutch football association rescinded the red card, saying Alvarado's reaction was triggered by the unprovoked attack on him - but adding that referee Bas Nijhuis was acting according to the rules when he sent the goalkeeper off.

The federation said Alvarado's reaction "will not result in a ban."

Opinions were divided about whether Alvarado deserved to be sent off in the first place.

Nijhuis defended the decision, saying that once the supporter was on the ground, he no longer posed a threat.

But Ajax coach Frank de Boer noted that for all Alvarado knew, the supporter could have been carrying a weapon or gotten up to attack again.

"Maybe I would have done the same thing, maybe not," said De Boer, a renowned former defender for Netherlands' national team, of Alvarado's reaction. "But emotionally I do understand it."

The Dutch players' union had demanded that the red card be retracted.

"This cannot lead to a suspension" for Alvarado, said union chief Danny Hesp, arguing that Alvarado's reaction was in self-defense after an unexpected, unprovoked attack. The union "will do everything it can to fight this" decision, he said.

The federation said Thursday it will decide "soon" whether Wednesday's match should be replayed, resumed, or have Ajax declared the winner.

Police are holding the 19-year-old supporter, whose name was not released, on assault charges. Police are also holding 25 other supporters arrested during and after the match. After the early end to the round-of-16 match, Ajax supporters clashed with riot police outside Amsterdam's ArenA stadium.

Alkmaar defended its decision not to continue playing. The team's players "didn't feel safe anymore in this situation," said club director Toon Gerbrands.

In a highly unusual move, the country's justice minister Ivo Opstelten got involved in the debate, saying the attack was "beastly" and that "jerks and nuts don't belong on the field." He added that he thought AZ's Verbeek was right to walk out under the circumstances.

"I have a lot of respect for how he acted," Opstelten said. "Intervene immediately, that warms my heart."

Slop, the Ajax director, apologized for the security lapse, and he said AZ had accepted the apology.

"An incident with one half-wit in a stadium of 40,000 people, you don't have control over that," he said. He said the supporter had "in all likelihood been drinking."

He added that the fan "had made it known that he detests the AZ keeper and that's why he attacked him."

Skeptics cast doubt on Fukushima status, even as Japan declares nuclear reactors 'stable'

Japan's government declared that the damaged reactors from the Fukushima disaster were 'stable.' Not everyone is convinced.

The Japanese government announced that the Fukushima nuclear complex, heavily damaged by the March 11 tsunami in the world's worst nuclear disaster since Chernobyl, is now stable.? But serious doubts remain about Fukushima's status, as officials remain unable to confirm the status of the reactors' fuel and an undercover report impugns the clean-up efforts' efficacy.

Prime Minister Yoshihiko Noda told a government nuclear emergency meeting that "The reactors have reached a state of cold shutdown" and are "stable," reports Reuters.? Mr. Noda and his environment and nuclear crisis minister, Goshi Hosono, both said that the situation at the plant is under control, though the clean-up may still take decades.? The Tokyo Electric Power Co. (TEPCO), which operates the reactor and has been leading the clean-up, had been attempting to achieve cold shutdown before the end of the year.

The state of "cold shutdown" means that the water used to cool the nuclear fuel rods in the reactors is at a temperature below boiling, thereby preventing the fuel rods from overheating and emitting excessive radiation. The Japan Times reports that government officials said that the temperatures of the lower portions of the rods' containment vessels measure 38.9 degrees C in reactor 1, 67.5 degrees in reactor 2, and 57.4 degrees in reactor 3.? "If the authorities are correct and cooling of the reactors is stable, it would be an important milestone in ending the world's worst nuclear accident since the 1986 Chernobyl crisis," writes the Times.

But the Times adds that skeptics worry that the readings would be inaccurate if the melted fuel rods punctured their containment vessels and fell to the bottoms of the outer containment tanks.? TEPCO has not been able to take direct measurements of the temperatures at the bottoms of the containment vessels, and the site is still too radioactive for the fuel rods' status to be visually confirmed.

Even if the reactor is under control, the cleanup could still take 30 years, and the problems remain "immense," writes The Wall Street Journal.

Indeed, there can be few firm declarations about the plant's status. Daiichi's reactors are littered with debris. Many measurement and control systems are on the blink. Radiation levels are too high for people to get close to the reactors, leaving engineers and scientists to make important judgments using computer simulations, scattered bits of data and guesses.

And whether the cleanup effort is moving ahead is dubious, according to an undercover report by freelance reporter Tomohiko Suzuki. Mr. Suzuki worked at the Fukushima No. 1 site for a month as a general laborer while documenting a long list of substandard practices and unsafe behavior by companies involved in cleanup at the plant. He charges that "absolutely no progress is being made" toward resolving the Fukushima crisis, reports the Mainichi Daily News.

Its design features a twistable, moldable "SecureFit" over-the-ear support piece and a wide assortment of differently-shaped and sized eartips, as well as iPhone controls built into the cable. With generous bass response, given its cost and size, the UltraFit3000 offers a generally solid audio performance, but at maximum volume, expect a very slight-but-forgivable amount of distortion on deep bass songs. While the fit is secure, there is an issue with ear-to-ear consistency that ultimately holds the UltraFit3000 back a bit.

Design
The Polk Audio UltraFit3000 is offered in three color schemes: white-and-orange, black-and-red, and the color scheme of our test unit, white-and-gray. The aforementioned "SecureFit" ear piece extends from the eartip that enters your canal and goes over the top ridge of your outer ear, tucking behind it. The cable extends from the end of the support tip and terminates at?about mid-chest. You have three cable options to attach at this termination point, the primary option is a longer (41-inch), flat-style cable (think: linguini) similar to the Monster Beats by Dr. Dre Tour High Resolution In-Ear Headphones ($149.95, 4 stars) cable. This cable comes with the built-in Apple three-button controls that operate playback, volume, menu navigation, and call answering. The second cable is a mere 14-inches, and is designed for minimal slack when using an MP3 player tucked into a shirt pocket or attached using a shirt clip. And a third cable is roughly 5-inches long and intended for tiny, shirt collar-attached players. Also included with the UltraFit3000: seven differently-sized and shaped eartip pairs, a shirt clip, and a soft zip-up pouch. The overall fit of the earphones is quite secure and excellent for the gym, but there are some inconsistency issues, from ear-to-ear, that we'll address in the next section.Polk Audio UltraFit3000 inline

Performance
On tracks with deep bass, as noted earlier, the UltraFit3000 sounds great at moderate-to-loud volumes, but begins to distort slightly at maximum volume when using an iPhone or laptop as your sound source. For instance, the Knife's "Silent Shout," a song with very deep bass, made the UltraFit3000 distort slightly at max volume, though not enough to really knock the earphones for. At reasonable volumes, on tracks with deep bass or not, the Ultrafit300 sounds fantastic, especially given the price. If you're the type to exercise to orchestral music?congratulations on your originality, by the way?you'll find the UltraFit3000's response rewarding, adding a nice resonance to the lower frequencies of the percussion and stringed instruments, while maintaining clarity in the mids and highs, in James Horner's?Star Trek II?film score. Bill Callahan's guitar work on?Apocalypse?sounds bright without being invasive, and the same treble presence lends itself nicely to the gravelly edge of his rich baritone vocals.?

One gripe: The moldable fit makes it possible to favor one ear over the other in terms of volume. The fit was always secure, for sure, but the over-ear support piece can press the driver of one ear more intensely against and into your canal than the other. It can be a bit difficult to achieve consistent fit from ear-to-ear, regardless of how incredibly secure the fit is, and this can mess with the stereo images by making one ear appear to be receiving more volume than the other. After some fiddling, this issue can be resolved, but not everyone will enjoy fiddling with them while jogging.

If absolute secure fit is your number one priority, the UltraFit3000 is not a bad option, but if you have a little more money to spend, the Editors' Choice Bowers & Wilkins C5 In-Ear Headphones ($179.95, 4.5 stars), though not specifically designed for exercise, are the most secure-fitting earphones we've ever tested, and they sound fantastic too.? In the realm of exercise earphones, another Editors' Choice, Sennheiser's CX 680 (now $89.95, 4 stars) is, at this point, an old standby in the category?the sweat-proof and secure-fitting result of a partnership with Adidas. They also happen to be washable?you can rinse them in running water?and they sound pretty excellent, especially for their price, which was lowered substantially recently. In short, the UltraFit3000 is an affordable earphone option, ideal for exercise?especially if you use an iPhone or iPod while you workout, but its minor fit and distortion issues hold it back from a slightly higher rating.

Sherry Vine: Memories of Bar d'O (PHOTOS)

Bar d'O will always stand out as one of the legendary shows of NYC nightlife. Nestled in a compact bar on Bedford St. in the West Village, Bar d'O was created by Jean Marc Houmard and Joey Arias and began in 1993 with Raven O and Edwidge. Shortly thereafter they gave birth to Sherry Vine, who joined the team. Bar d'O ran for 10 years and featured many stellar performers, and you never knew who was in the audience!

The annual Bar d'O reunion show means everything to me! Bar d'O really was the place where I developed my act and was educated by the masters, Joey Arias and Raven O. I was so shy; at first I wouldn't talk at all. Two years later, you couldn't get me to shut up! The reunion show offers a chance for the folks who visited Bar d'O and miss it as much as we do to have an injection from the past, as well as letting the kids witness a crazy, all-live show that they heard about and can't see anywhere else. At the time, Bar d'O was the only place in NYC to see a group of live, singing drag artists in one room.

I have so many special memories, most of them too scandalous for print! Most of my memories include the incredible staff and manager Ivan, who always let you know his opinion! Joey, Raven, and I singing "Sisters." Sade Pendavis ending "At This Moment" lying on the floor. Dancing on the sofa with Meg Ryan. Flying in from Milan and throwing it together for the reunion a few years ago -- I was so fried, but Jean Marc handed me a shot of tequila and said, "This will wake you up!" It worked!

Research shows hands-free phones just as risky

A driver uses a cellphone while driving Wednesday, Dec. 14, 2011, in Los Angeles. The National Transportation Safety Board declared Tuesday that texting, emailing or chatting on a cellphone while driving is just too dangerous to be allowed anywhere in the United States and is urging all states to impose total bans except for emergencies. (AP Photo/Damian Dovarganes)

(AP) ? Like it or not, when someone is talking to you, your brain is listening, processing and thinking about what's being said ? even when you're in the driver's seat trying to concentrate on traffic.

That's why drivers get distracted during cellphone conversations, even when using hands-free phones, researchers said. It's also part of the reason why the National Transportation Safety Board went ahead this week with a recommendation it knows a lot of drivers won't like ? that states ban hands-free, as well as handheld, cellphone use while driving.

It's not where your hands are, but where your mind is that counts, NTSB chairman Deborah Hersman told reporters.

The board doesn't have the power to force states to impose a ban, but its recommendations carry significant weight. And, judging from the public reaction, they've already started a national conversation on the subject. NTSB has been swamped with calls, emails and tweets from drivers both praising and condemning the action.

But it's the proposed hands-free ban that has generated the most controversy.

What's next? No passengers? No kids? No tuning the radio? Maybe NTSB will ban driving altogether, was the tenor of the response on Twitter.

The scientific evidence, however, is generally with NTSB, researchers said.

"There is a large body of evidence showing that talking on a phone, whether handheld or hands-free, impairs driving and increases your risk of having a crash," Anne McCartt, senior vice president for research at the Insurance Institute for Highway Safety, said.

Jim Hedlund, a safety consultant and former National Highway Traffic Safety Administration official, recently examined 300 cellphone studies for the Governors Highway Traffic Safety Administration. He couldn't recall a single study that showed drivers talking on a headset or hands-free phone were at any less risk of an accident than drivers with one hand on the wheel and a phone in the other.

A similar analysis for the government of Sweden recently came to the same conclusion: "There is no evidence suggesting that hands-free mobile phone use is less risky than handheld use."

What's missing is hard evidence that accidents are increasing because of cellphone use. One reason is that U.S. privacy laws have made it difficult for researchers to study whether cell phones were in use in accidents in the U.S. The two large studies that have been done ? in Canada and Australia ? found drivers were four times more likely to have a crash if talking on a cellphone. It didn't matter whether the cellphone was hands-free or handheld.

But that hasn't translated to an increase in highway fatalities in the U.S., which hit their lowest level since 1949 last year.

Of 6,000 drivers surveyed by the highway administration, 40 percent said they don't consider it unsafe for drivers to talk on a hands-free cell phone. Less than 12 percent said that about a hand-held phone.

Marcel Just, director of Carnegie Mellon University's Center for Cognitive Brain Imaging, isn't surprised.

It's counterintuitive to think that hands-free talking is dangerous because people don't have any sense that their conversation is draining brain power away from driving, but that's exactly what's happening, he said.

Just is the co-author of a 2008 study that used driving simulators to test the performance of drivers not engaged in conversation and drivers who could hear someone talking to them through headphones. Drivers took the simulator tests inside an MRI (magnetic resonance imaging) machine that recorded images of changes in their brains while driving, including which areas of the brain were used for driving. The amount of the brain devoted to driving was 37 percent less in drivers who could hear someone talking to them than for drivers not using cellphones.

"The human mind can multitask, but each task is performed with less brain power and lower proficiency," Just said.

The driving simulators also showed a deterioration of skills on the part of drivers who could hear someone talking to them, including weaving between lanes and edging over the side of the road.

"When someone is speaking your native language, you can't will yourself to not hear and process it. It just goes in," Just said. Even if a driver tries to ignore the words, scientists "can see activation in the auditory cortex, in the language areas (of the brain). "

Accident investigators have seen cases of drivers talking on hands-free phones whose minds are so engrossed in their conversations that they ran into something plainly visible.

In a 2004, a bus driver taking students on a class trip drove his 12-foot-high bus into a 10-foot, 2-inch-high bridge arch in Alexandria, Va., peeling off the roof of the bus. There were signs warning drivers about the height of the bridge, and the bus driver was familiar with the route. He also saw a bus in front of him change lanes to avoid the low arch. But the bus driver, who was talking a hands-free phone at the time, drove right into it.

"There is a standard code for crash investigations called roughly 'look, but didn't see.' In other words, I was looking in the right place, but I didn't register what was there," Hedlund said.

Of course, drivers don't have to be using cell phones to have conversations ? they talk with passengers all the time. But talking to an adult passenger doesn't involve the same risk as a phone conversation, researchers said. That's because passengers are engaged in the driving experience with the driver. If they see a danger, they'll usually warn the driver. Passengers also tend to instinctually adjust their conversation to the level of traffic and other difficulties confronting the driver.

There are lots of other things that go on in cars that are risky: eating and drinking, tuning the radio, studying maps and applying makeup, for example. Just like talking on the phone, most of those things involve a choice by the driver.

As for the screaming toddler in the backseat demanding attention, "some things are just part of life," McCartt said.

HP Omni 220-1080qd

The HP Omni 220-1080qd ($999.99 direct) is one of the few all-in-one desktop PCs that doesn't come equipped with a capacitive touch screen?an extra feature that hikes up the price. Rather, HP has designed a desktop with a better Core i7 CPU, discrete GPU, and USB 3.0 interfaces?which is more than most all-in-one PCs have to offer at this price point. That said, the system isn't perfect; I would have liked to have seen an HDMI-input, which would keep the Omni 220-1080qd useful long after the internal components become obsolete. But even so, it's still top among its competitors, which is why it earns our Editors' Choice for midrange all-in-one desktops.

Design & Features
The Omni 220-1080qd has a slim black plastic chassis; the uniform color is broken up by a silver band that runs along its edges. The 21.5-inch monitor displays in full 1080p HD (1,920-by-1,080 resolution), and is held up by a bent arm much like the Apple iMac 21.5-inch (Thunderbolt) ($1,199 list, 4.5 stars). Sitting above the display is an integrated Webcam and directly underneath is an integrated speaker. The Omni 220-1080qd comes equipped with Beats Audio software, which helps increase the bass output, and also adjusts the sound settings depending on what kind of media you're viewing or listening to. There are settings to adjust the audio to be better suited for music, podcasts, and movies, or you can customize these settings yourself.

The Omni 220-1080qd's integrated speakers will provide a great listening experience. While watching the "Inception" trailer on YouTube I noticed the depth of the "Bwah" sounded fuller. You can turn the Beats Audio on and off through a shortcut on the keyboard. When I switched it off, however, I noticed that the audio sounded pretty flat, like a laptop's speakers.

Along the left side of the Omni 220-1080qd are two USB 3.0 ports, headphone and microphone jacks, and a media card reader (SD/MS/xD). On the other side is a tray-loading DVD+-RW and Blu-ray player?a feature most all-in-ones, like the Sony VAIO VPC-L231FX/W ($999.99 list, 4.5 stars), lack at this price point. On the back of the system, there are four USB 2.0 ports (two of which are taken up by the wired keyboard and mouse), Ethernet, and speaker jack. Integrated 802.11n Wi-Fi is also onboard. There's no HDMI video output, but I would have liked to see at least an HDMI video input, which would allow you to utilize the Omni 220-1080qd's display by hooking it up to a gaming console or another PC?ultimately increasing its usability long after the internal components have become obsolete.

The Omni 220-1080qd comes with a huge 1TB hard drive, but it also comes bogged down with bloatware. Zya music player, Blio ereader, WebOS, and eBay shortcuts litter the desktop. Hidden in the control panel are two more ereaders (Kobo and Zinio Reader 4), and a Bing and Ask toolbar are just lying in wait to attach themselves to your dedicated browser. HP does include a useful piece of software called LinkUp. This program can be downloaded to other (non-HP) computers and allows you to share files on these computers within your home's network. It's like having your own personal cloud.

Performance
HP Omni 220-1080qd The Omni 220-1080qd comes equipped with high-end components, including a 2.8GHz Intel Core i7-2600S processor, 6GB of RAM, and an AMD Radeon HD 6450 discrete graphics processor. These components are far more powerful than what even the Editors' Choice Sony VAIO VPC-L231FX/W offers (Core i3-2320M). The Omni 220-1080qd's Core i7 (2,690) processor trounced the Sony VPC-L231FX/W's Core i3 (2,167) in day-to-day tests like PCMark 7, coming out 523 points ahead. The performance difference between the two was further seen while the two systems ran through our Photoshop CS5 script, which took advantage of the Omni 220-1080qd's quad-core processor, completing the test in 3 minutes 46 second, which is significantly faster than the dual-core-CPU-equipped Sony VPC-L231FX/W (5:34), but not quite as fast as the more media-oriented Apple iMac (3:29). In Cinebench R11.5 3D rendering tests, the Omni 220-1080qd (5.67) scored a full point higher than the iMac (4.13) and then some.

In gaming tests, the Omni 220-1080qd's AMD Radeon HD 6450A graphics proved to be a bit weak, running higher-end titles like Crysis in DirectX 10 at 29.3 frames per second (fps) on and Lost Planet 2 (Direct X 11) at 13.4fps (both on Medium settings and 1,280-by-720 resolution). It was slower than the Apple iMac's more powerful Radeon HD 6750M (70fps in Crysis, 32fps in Lost Planet 2). The Omni 220-1080qd won't give you great performance if you're looking to play high-end titles, but if your gaming lies more in the World of Warcraft and Sims 3 range then you should be fine.

The HP Omni 220-1080qd is a great all-in-one, especially for those who have no desire for a PC with a touch screen. HP has loaded this unit up with a Blu-ray player, Core i7 processor, and two USB 3.0 ports?offering more media features than the Editors' Choice Apple iMac. However, it lacks one major feature that other all-in-ones, like the Editors' Choice Sony VAIO VPC-L231FX/W, have in this price range?an HDMI-in port. If performance is more important to you than features, the Apple iMac 21.5-inch (Thunderbolt) will give you better gaming performance, but in multimedia-oriented and day-to-day tasks, the Omni 220-1080qd and the iMac are equals. Because of its features and strong performance for its price, the Omni 220-1080qd earns our Editors' Choice for all-in-one PCs.

George Hobica: Confessions Of An Airline Revenue Manager

Every airline employs a cadre of fare revenue managers. These are the folks who adjust airfares throughout the day, depending on route, season, demand, supply and other factors. They're a notoriously tight-lipped bunch, but, on condition of anonymity, we got one to explain how the fare game works.

Is there a best time of the day or best day of the week to buy airline tickets?

No. We constantly read stories from pundits who proclaim that Tuesday nights are the best or Saturday at midnight is the lowest time for airfares, but that is not entirely true. Each airline loads fares at different times of the day every day. To say that there is one time of the day or one day of the week that is better than another is false.

Plus, fares are so dynamic since they are based on market conditions and the actual number of passengers who are currently booked on a specific flight that they can change rapidly at any time. Many airlines tend to announce sales on a Monday leading other airlines to match certain fares the following day, but this is not a hard and fast rule. It truly varies from airline to airline.

What is your role as a revenue manager?

Each airline has a complex computer system based on algorithms that can maximize the profit on each flight based on the types of fares offered on that specific flight. On one flight, there could be as many as two dozen different fares based on different factors such as advance purchase or how many days you stay at the destination. The computer knows that, by releasing (for example) 5 seats at a very low price, 10 seats at a slightly higher price and 20 seats at a slightly higher price, it can maximize revenue as the flight fills up.

On a full flight, we no longer want to offer that el-cheapo fare because it is based on supply and demand. The computer adjusts fares all the way up until the departure time, but as a revenue manager, I can go in and adjust things based on information that the computer may not know. For example, are there specific events taking place at a destination? Are there certain conditions at the departure airport that will allow more than the desired amount of seats to go empty such as weather?

Do airfares really change four times a day?

Yes and no. Some of them change that often -- especially on high-trafficked routes -- but most of the time you will see the same fares for a few days unless they sell out. The biggest changes happen at 21 days, 14 days, 10 days, 7 days and 4 days, typically when advance purchase restrictions knock fares up a notch. Domestic fares can change four times a day. International fares can change hourly, but again won't necessarily adjust that often unless there's a lot of traffic on that specific route. The majority of fare changes happen because people are purchasing up inventory or the advance purchase restrictions are kicking in.

Why is it that sometimes I can wait until the last minute and find a cheap fare, but other times the fare goes up?

Well, most of the time the fare will go up because the flight will be filling up or the advance purchase restrictions will be kicking in. But on routes with significant competition -- New York to Los Angeles for example -- airlines may have sales or "dump seats" at the last minute to fill the plane if it's not particularly full. It also depends on the day of the week. Tuesday, Wednesday and Saturday are often the cheapest days to fly because we carry fewer business passengers those days.

Why do airlines advertise sales and then I can never find the tickets available at the stated price?

When an airline puts seats on sale, not every item in the store is for sale, just a percentage. Plus, not every flight on a given route may offer seats for sale. A popular 6 p.m. flight may not have anything on sale since people are willing to pay full price for it whereas the early bird 5 a.m. flight may have more seats on sale. When airfares go down, jump on it. The limited capacity of seats will dwindle as time passes.

Why are there so few award seats out there? Each time I try to use my miles, I can't.

This is really a false assumption. There are a lot of award seats out there. We often give away 10-15 percent of our seats as award seats. We are operating a business, and our shareholders wouldn't like it if we passed on top-line revenue. If you are flexible with dates or flight times, there are lots of award seats out there. If a flight is not filling up as we may expect, we can open up award availability as the departure date approaches.

Who is more profitable to you: a connecting passenger or a nonstop passenger?

That's a complicated question. Let's say Jack is taking a nonstop flight from Miami to Los Angeles. He will probably pay a slightly higher fare to take that nonstop flight than Jill who is flying Miami to LA via Atlanta. So in that respect, he is more profitable. He also is easier to handle because the airline does not have to carry him on two flights, connect his bags, serve him drinks twice, handle him at our hub lounges, etc.

However, in another example like Atlanta-Miami, it may be more profitable for us to carry someone from Los Angeles to Miami via Atlanta than carry them just from Atlanta to Miami where we have heavy competition and very discounted fares. You may think that is strange since Atlanta to Miami is a shorter flight. It depends on competition and the length of the route.
